Fakta Hari Ini – Agenda Perpaduan Melayu

UMNO ada 31 kerusi di Konstituensi Majoriti Melayu di Semenanjung yang dimenangi dengan majoriti 32-72% berbanding PAS ada 4 kerusi sahaja itupun dimenangi antara 21-27%. Apakah benar dakwaan penyokong PAS bahawa Agenda Perpaduan Melayu untuk menyelamatkan UMNO?

Sultan Baru Untuk Kelantan

YTM Tengku Muhammad Faris Petra hari ini di Mahsyurkan sebagai Al Sultan Kelantan yang baru.

Pemahsyuran di umumkan oleh Menteri Besar Kelantan.

Ia di lakukan berdasarkan peruntukan 23A di dalam Undang-Undang Perlembagaan Tuboh Negeri Kelantan yang dikatakan telah diwartakan pada  22 Julai 2010.

Ini merupakan peruntukan baru dalam Perlembagaan Tuboh Negeri.

Sebelum ini tiada peruntukan di dalam Undang-Undang Tuboh Negeri membenarkan seorang Sultan diturunkan dari tahta melainkan dengan kerelaan atau setelah baginda mangkat.

Sebelum ini ura-ura untuk meminda Perlembagaan Tuboh Negeri telah kencang bertiup semenjak awal 2010 lagi. Bagaimanapun adalah disangkakan bahawa sebarang usaha meminda Undang-Undang Perlembagaan Tuboh Negeri hendaklah dilakukan di Dewan Undangan Negeri Kelantan dan dengan mendapat persetujuan tidak kurang daripada 2/3 ahli Dewan.

Bagaimanapun, sumber blog ini yang berada di Majlis Permahsyuran tersebut memberitahu bahawa, di luar pengetahuan banyak pihak, sebarang bentuk pindaan Undang-Undang Perlembagaan Tuboh Negeri yang melibatkan tahta boleh dipinda menerusi   Majlis Penasihat Sultan.  Adalah difahamkan badan tersebut telah melakukan pindaan ini.

Menurut The Malaysian Insider pula, pindaan tersebut telah diwartakan pada 22 Julai 2010.

Menurut sumber dalam Kerajaan Negeri Kelantan, pindaan ini dibuat bersesuaian dengan Peruntukan III (2) Bahagian Ke Dua Undang-Undang Perlembagaan Tuboh Negeri Kelantan seperti di bawah,

III. (1) The following provisions of this article shall have effect with respect to the amendment of this Part of the Constitution of the State.

III. (2) The provisions affecting -

(a) the succession to the throne and Malays customary dignitaries,

(b) the appointment and attributes of an heir or heirs to the throne, of the Ruler’s Consort or of the Regent or Members of the Council of Regency of the State,

(c) the removal, withdrawal or abdication of the Sovereign or His heir or heirs,

(d) the appointment and attributes of the Ruling Chiefs or similar Malays customary dignitaries and of members of the Council of Religion and Malay Custom, Council of Succession, Council of Advisers or similar bodies, and

(e) the establishment, regulation, confirmation and deprivation of Malay customary ranks, titles, honours, dignitaries and awards ant the attributes of the holders thereof and the regulation of the royal courts and palaces,

may be amended by His Highness by Proclamation issued with the consent and concurrence of the Council of Advisers but may not be amended by any other means.

Masih berdaulatkah Undang-Undang Tuboh Negeri Kelantan…

… dan Perlembagaan Persekutuan.

Sebelum wujudnya Persekutuan Tanah Melayu, Negeri-Negeri Melayu Bersekutu dan Tidak Bersekutu adalah milik DYMM Raja-Raja Melayu di negeri-negeri tersebut.

Selepas Perjanjian Persekutuan 1948, Raja-Raja Melayu bersetuju menyerahkan kuasa mutlak mereka termasuk pemilikan mereka terhadap tanah jajahan dan naungan mereka. Daripada sistem Raja Multak, sebuah sistem Raja Berpelembagaan di perkenalkan. Hak dan kekuasaan Raja-Raja Melayu terbatas oleh Perlembagaan di Peringkat Persekutuan dan Undang-Undang Perlembagaan Tuboh Negeri di Negeri-Negeri Melayu.

Bagaimanapun, Inggeris menjamin bahawa raja-raja Melayu akan terjamin tahta mereka dan tidak boleh diturunkan dari tahta tanpa kerelaan mereka melainkan bila nyawa berpisah daripada badan.

Tetapi ada peguam yang berusaha naik turun banyak anak tangga untuk memanipulasi beberapa ruang-ruang samar di dalam perlembagaan untuk membolehkan seorang raja Melayu diturunkan dari tahtanya.

Saya minta kita sama-sama merenung sejenak tentang keluhuran Perlembagaan dan Kedaulatan Undang-Undang.

Sebenarnya, kita tidak perlu 2/3 undi di Parlimen dan Dewan Undangan Negeri untuk meminda Perlembagaan Persekutuan dan Undang-Undang Perlembagaan Tuboh Negeri. Yang kita perlu ialah rakyat yang daif hal perlembagaan dan perundangan dan barisan pimpinan yang ada kepentingan diri. Cukuplah. Berkuburlah keluhuran dan kedaulatan.

Ini mungkin permulaan. tetapi jika kita biarkan sahaja, sudah tentu ia akan menjadi permulaan untuk banyak lagi dan penghujungnya ialah tergadainya hak kepada yang berhak. Dan yang berhak itu termasuklah kita sendiri, orang-orang Melayu.

Cepat Dollah, Cendol Nak Habis

Tajuk di atas, sepatutnya menjadi tajuk posting saya, pada Hari Nuzul Al Quran, dua Ramadan yang lalu. Namun ia tidak pernah menjadi nyata kerana pada petang tersebut, tiga anggota polis dari Bukit Aman telah datang dan menahan saya.

Hari ini, hari terakhir Ramadan 1431. Hari yang menyayat hati bagi saya. Terasa terlalu pantas Ramadan berlalu dan terlalu lama lagi untuk menanti Ramadan yang akan datang, itupun jika dipanjangkan usia oleh Yang Maha Kuasa.

Banyak perkara yang sentiasa mengingatkan saya pada Ramadan. Kalau waktu kecil-kecil dahulu, Ramadan di kampung akan sering mengingatkan saya pada bau minyak tanah sewaktu pelita dipasang menjelang Maghrib dan bunyi dentuman meriam buluh dan meriam ubat karbaid.

Paling tidak dapat saya lupakan sewaktu kecil ialah bila abang saya yang berkhidmat dalam Angkatan Tentera pulang untuk menyambut Syawal bersama kami di kampung.

Pada satu malam selepas berbuka, beliau memasang apa yang disebut, ‘Thunder Flare’. Apabila ia diletupkan, bunyi dan cahayanya meriuhkan satu kampung.

Orang-orang tua kampung keluar dengan lampu suluh bertanya satu sama lain apakah yang telah berlaku.

“Tok tahu, khabar-khabar tum!’ kata Arwah Che Weil Dakwah, yang tinggal dihadapan rumah kami.

Tetapi, yang paling indah dan paling saya rindukan ialah bertukar-tukar lauk di antara jiran sekampung setiap petang.

Tidak kurang juga insiden menggelikan hati antaranya ialah bila waktu sembahyang terawih, budak-budak kampung di saf belakang akan menjerit kuat-kuat, “Cepat Dollah, cendol nak habis….”

Dan mereka mengikat mercun tarik pada selipar-selipar jepun para jemaah. Tidak kurang juga yang menanti orang kampung melintas untuk dilemparkan mercun katak.

Tahun ini adalah tahun kedua kami sekeluarga akan menyambut Syawal tanpa Arwah Mama.

Ramadan jugalah kali terakhir saya memasak untuk Mama sebelum beliau di bawa ke Kuala Lumpur untuk rawatan lanjut dan seterusnya menetap di Kuala Lumpur hingga akhir hayatnya.

Mama suka memasak dan Mama suka makan. Setiap Syawal, Mama akan selalu buat Soto Ayam dengan Begedel. Memandangkan kami adik beradik semua sukakan begedel, maka setiap kali makan, catuan terpaksa dilakukan.

Tetapi seingat saya, saya tidak pernah sukakan Soto. Sehinggalah apabila arwah Mama sudah tiada lagi. Saya menjadi rindu hendak makan Soto. Tiap kali berkesempatan, saya pasti mencuba. Malangnya, sukarnya untuk menikmati masakan seperti Arwah Mama.

Mungkin begitulah dijadikan lumrah bagi kita manusia.

Bila ada, kita tidak menghargainya tetapi bila sudah tiada, baru kita terngadah.

Belajar dari kesilapan, tahun ini, saya cuba sedaya upaya menikmati Ramadan yang datang. Syukur, kali ini saya betul-betul dapat menikmatinya, walaupun tanpa bau minyak tanah dan tanpa dentuman meriam buluh.

Dan buat pertama kalinya setelah sekian lama, saya akan berpeluang untuk menyambut satu Syawal bersama kakak-kakak dan abang saya. Terlalu lama saya tidak berkesempatan meraikan satu Syawal dengan mereka sehingga saya sudah lupa bilakah kali terakhir kami menyambutnya bersama.

Khabarnya, ada yang akan membuat Soto di Aidil Fitri ini.

Kepada Muslimin dan Muslimat saya ucapkan selamat menyambut Aidil Fitri dan kepada pembaca blog ini, saya mohon ampun dan maaf di atas segala kesilapan dan kekasaran.

Semoga Ramadan yang berlalu mengajar kita betapa pentingnya untuk kita menyempurnakan hubungan sesama kita, supaya lengkaplah hubungan kita dengan Yang Maha Pencipta.

Not the time to play politics

PAS leader Datuk Nik Aziz Nik Mat won brownie points among the non-Malays for his defence of Teo Nie Ching’s faux pax in a Selangor surau. But compromising on such issues may have lost his party ground among the Malays.

SERDANG MP Teo Nie Ching rushed to the High Court on Monday morning in the hope of meeting Datuk Nik Abdul Aziz Nik Mat who was there for the Kelantan government’s suit against Petronas.

But when she got there, she was told the Kelantan Mentri Besar was about to leave for the mosque to perform sembahyang hajat or special prayers.

Teo was advised to go and wait at Kelantan House where Nik Aziz puts up when he is in Kuala Lumpur. Her persistence paid off and she met Nik Aziz for about 15 minutes over what some have called her political baptism of fire.

There had been an uproar when a photograph of the petite and pretty DAP politician making a speech in the Surau Al-Huda in Kajang appeared on the front page of a leading Malay newspaper.

The photograph showed her speaking into a microphone in the dewan solat or prayer court of the surau (No-no Number 1); her head was uncovered (No-no Number 2); and she was wearing a form fitting baju kebaya or what some have labelled an “SIA stewardess uniform” (No-no Number 3).

DAP leaders slammed the news report as “Umno-instigated” and accused the paper of blowing the issue out of proportion.

But behind the scenes, they knew the reaction among Muslims out there was not entirely about politics and they were concerned about how to handle the fallout.

Teo had crossed the line and this became all too clear when word came from the state government that the Sultan of Selangor, the Islamic head in the state, was upset about the matter.

From that point, the DAP defence that Teo had not done anything wrong ground to a stop and she was advised to apologise to the Sultan. Her letter of apology was handed to the Sultan by the Selangor Mentri Besar a few days later.

DAP leaders also approached their PAS colleagues for advice and that was when it was suggested that Teo should try to meet Nik Aziz.

The tvpas.com video of the meeting showed Nik Aziz doing most of the talking while Teo did all the nodding.

Teo is a practising lawyer, a vivacious speaker and fluent in Bahasa Malaysia. The novice politician made a huge impact in the last elections because she was such a natural and confident speaker.

But she has been under a lot of pressure in the last couple of weeks and seemed overwhelmed by Nik Aziz and was virtually sitting on the edge of the white sofa, her hands clasped on her lap.

Officially, the purpose of meeting Nik Aziz was for Teo to seek advice but the real aim was to signal to the Malay ground that Teo had been “absolved” of the faux pax by the Tok Guru.

“This is too much and in the holiest month for the Muslims. She ran to Nik Aziz because she wanted a political solution. If she really wanted religious advice, she should have gone to the mufti,” said pro-Umno blogger Zakhir Mohamed.

Teo has since resumed her Ramadan duties in more demure fashion, opting for the modest baju kurung and a variety of shawls for events at the surau or mosque.

PKR’s William Leong, the Selayang MP, also came under fire following reports in the same Malay daily that he had given a tazkirah or religious talk at the Masjid at-Fakwa.

Leong has been rather level-headed about the whole incident.

“I wouldn’t know how to give a tazkirah even if I wanted to. Besides, it is not as though I barged in and grabbed the mike. I was invited by the mosque committee,” he said.

But Leong probably came under less pressure because he is a man and a lot of activities revolving around the mosque are run by men.

A corporate lawyer, Leong’s experience of Ramadan before going into politics was breaking fast with his corporate clients in hotels. It has been a sharp learning curve and he now finds himself making donations to orphans, single mothers and the poor.

Actually, the relationship between politicians and mosques is an old story. Over the years religion has given politics and politicians a legitimacy that they would otherwise not enjoy among a large segment of Muslims and Malays and no other parties play it as intensely as Umno and PAS.

But non-Muslims making speeches in the prayer court is something else, hence the unequivocal response from the Selangor Sultan whose opinion about keeping the mosque and surau free of partisan politics is well known.

On Wednesday, the Selangor palace issued an order stating that non-Muslims are not permitted to enter the prayer court of mosques or surauwithout permission from the Selangor Islamic Religious Council (Mais).

Selangor is also touchy about politicians speaking in the mosque, no matter how well-versed they may be in their religious knowledge.

Earlier last month, when opening a religious primary school in the state, the Sultan had urged Muslims to step up efforts to overcome problems that posed a challenge to the institution of Islam. Among these challenges were the use of the word ‘’Allah’’ by non-Muslims, deviant teaching, misuse of mosques and social issues affecting young Muslims.

Clear signals on transgressions

The Raja Muda of Perak, Raja Dr Nazrin Shah, in a speech in Ipoh a few days after the incident, cautioned that “major transgressions in Islam begin from small acts” and that it could start from a suraumadrasah ormasjid, or from a speech, khutbahtazkirah or doa. There was no mistaking what he was referring to.

The two royals are sending clear signals on where they stand on religious matters.

There is no denying that reports on the Teo and Leong incidents were somewhat exaggerated especially the allegations that they had delivered tazkirah. If Teo was not even aware of how women ought to dress in religious settings, she could hardly be capable of a tazkirah.

At the same time, politicians like them are challenging stereotypical perceptions of the role of elected representatives. The new breed wants to be YBs for all races and that is something for everyone to think about in the new political landscape.

Several leading ulama such as Perak mufti Tan Sri Harussani Zakaria and Johor religious advisor Datuk Nooh Gadot jumped into the fray but most Malay politicians steered clear of it.

No Malay politician worth his salt wants to mess around with the palace and most have been in the game long enough to know the specifics of mosque etiquette.

PAS president Datuk Seri Hadi Awang, for one, was mum throughout. His silence was read as disapproval of what had happened. Party insiders said opinion on the matter had been divided at the PAS central working committee meeting last Sunday night.

But PAS intellectual and Kuala Selangor MP Dr Dzulkifly Ahmad said: “There is a great divide given the emerging two-party system taking place. The one willing to be in touch with the changing political landscape will be the one who will survive the new political contestation. It does not pay to take a jaundiced view of religion.”

Nevertheless, not everyone in PAS is happy with Nik Aziz’s stand. They say his political side seems to be dominating the ulama in him these days.

He had gone out of his way to defend DAP on the cancellation of the Malidur Rasul procession in Penang and the incident where Perak DAP leader Nga Kor Ming mispronounced Koranic verses.

More recently, there was the furore over the khutbah in Penang during which the imam neglected to pray for the Agong who is the head of Islam in the country but mentioned the Chief Minister’s name instead.

The debate among ordinary Muslims has generally not been sympathetic to Teo’s blunder. There are those who are clearly angry and feel she had not shown respect to their religious norms.

The more reasonable excuse her attire to ignorance but say she had transgressed certain boundaries by entering the prayer court.

“Mosques should be opened to non-Muslims but not the dewan solatand not in that kind of outfit. I’m not comfortable with that,” said one young Malay lawyer.

It is quite clear that DAP leaders work well with the consummate politician that Nik Aziz is.

He has become some sort of Band-Aid to the DAP when they stumble, fall and scrape their knee. To put it more bluntly, some think he has become an apologist for the DAP.

Those in Pakatan Rakyat call it coalition politics – that parties should help each other.

Nik Aziz won brownie points among the non-Malays but it is doubtful if he has won any ground among the Muslims on this issue.

The fasting month is a time for prayer, reflection and good deeds and Malay politicians often try to downplay politics during this special time.

But, said the well-known and controversial blogger Syed Azidi Syed Abdul Aziz also known as Kickdefella: “One political incident after another, this is a highly political Ramadan.”

Aidil Fitri Terakhir?

Mungkin Aidil Fitri kali ini adalah Aidil Fitri terakhir bagi kita. Tahun depan, mungkin masa depan kita sebagai umat Islam di negara ini dan masa depan budaya kita sebagai orang Melayu akan ditentukan oleh Khalid Samad, Dr Dzul dan Dr. Hatta setelah hanya berunding dengan Lim Kit Siang, Lim Guan Eng, Teresa Kok, Tian Chua, Ronnie Liu, Chua Jui Ming, dan lain-lain pimpinan bukan Islam yang menguasai majoriti Kerajaan seterusnya.

Semata-mata kerana ada pihak yang terlalu takut untuk menyebut kalimah Melayu.

Di manakah Melayu? Usahkan gagah di Nusantara, di bumi sendiri pun kita sudah hampir pupus.

Dua malam lepas saya dimaklumkan bahawa terdapat lebih 1 juta orang pemilih baru didaftarkan oleh DAP yang kebanyakannya terdiri daripada warganegara Malaysia berketurunan Cina yang telah lama menetap atau berkerja di luar negara. Selain usaha-usaha memindahkan pengundi-pengundi Cina dari kawasan pemilih Melayu kurang daripada 20% ke kawasan pemilih Melayu yang lebih tinggi. Ia adalah satu usaha untuk mencairkan pengaruh pemilih Melayu dan berharap dengan perpecahan orang-orang Melayu, mereka hanya memerlukan 20% pengundi Melayu untuk mengundi mereka maka, kebanyakan konstituensi di mana pemilih Melayu 70% ke bawah akan tidak lagi dikuasai oleh Melayu.

Saya akan lengkapkan data-data itu untuk posting selepas Aidl Fitri.

Tetapi sementara itu kita harus bertanya pada diri kita, usaha kita mengagungkan Pimpinan Bukan Islam masuk ke ruang-ruang sembahyang surau kita itu untuk apa. Adakah untuk mengagungkan Islam atau untuk membuka pintu hati orang-orang Melayu di saf-saf sholat supaya membuka mata mereka dan membuka hati mereka menerima pimpinan DAP dan pimpinan Bukan Islam PKR. Menerima politik DAP?

Adakah DAP dan PKR membuka ruang kepada ulama-ulama kita untuk masuk ke ruang-ruang ibadat mereka supaya pemilih-pemilih mereka terbuka mata dan hati untuk menerima Islam?

Apakah kita bangga dengan usaha mendoakan supaya Lim Guan Eng dibuka hati untuk menerima hidayah dan seruan Islam atau mungkinkah itu hanya satu agenda politik supaya kita merasa tenang dan aman dengan pemerintahan Lim Guan Eng.

Cuba bayangkan senario sebaliknya, bila di Gereja-Gereja, di Kuil-Kuil dan di Tokong-Tokong mendoakan pula supaya Tuan Guru Nik Abdul Aziz dibuka hati dan diberi hidayah supaya keluar daripada Islam dan memeluk agama Kristian, Buddha atau Hindu.

Che Khalib Makan Pisang Ke?
